Heated Legal Debate Over Secret GPS Tracking and 4th Amendment Rights

gps tracking secretly by government is legalAccording to the latest ruling out of the Ninth Circuit Court, it’s perfectly legal for state, local, or federal agents to secretly plant a GPS tracking system on your car in the middle of the night, even if it’s parked in your driveway, and then use said GPS vehicle tracking system to track your movements as they see fit. BAscially the ruling says that federal agents can secretly install a GPS vehicle tracking device into your car without a warrant – and this doesn’t violate a citizen’s Fourth Amendment rights.

The ruling, which sets precedent for Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon and Washington, holds that “the right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures” doesn’t apply to driveways. But the Ninth Circuit doesn’t make precedent for the whole country, and the U.S. Court of Appeals for the District of Columbia recently ruled that extended tracking via GPS requires a warrant. But, since conflicting precedent has now been set on the West Coast, this issue is bound for the Supreme Court.

In the case, DEA agents secretly planted a GPS vehicle tracking system on Juan Pineda-Moreno’s Jeep at night while it was parked outside his home, and then used it to pinpoint the illegal marijuana crop he was cultivating. Pineda-Moreno appealed the case on the grounds that the secret GPS tracking violated his Fourth Amendment rights, but a three-judge panel denied his appeal in January and a larger panel ruled this month against reconsidering the case.

Student Finds FBI GPS Tracking Device Secretly Placed in His Vehicle

FBI GPS vehicle tracking system A 20-year-old college student in California recently found a GPS vehicle tracking device belonging to the FBI that had been secretly attached to his car. The FBI even showed up to his apartment a few days later and took the GPS tracking device back!

The student, Yasir Afifi, had taken his car in for a routine oil change when he and the oil change technician noticed wires hanging from a black box underneath his car. Neither one of the men knew what the device exactly was, so they immediately removed it from the vehicle.

Shortly after, not knowing exactly what the black box was or who had put it there, a friend of Afifi’s posted images of the GPS tracking device online. Next thing you know, about 48 hours later, 6 FBI agents showed up at Afifi’s apartment in Santa Clara, California, demanding that he immediately returned the GPS vehicle tracking device. The GPS tracking device was identified as a police-issue-only Cobham Orion Guardian ST82 vehicle tracking system.

Chrysler Launches New Electronic GPS Vehicle Tracking System

City Fleets Use Eco-Friendly Oil Filters to Reduce Expenses

According to Kelly Tidwell of Pure Power!, use of the company’s cleanable, reusable oil filter can extend oil change intervals two to four times longer than traditional filters. The Culver City Fleet is ranked # 7 on the 2010 100 Best Fleets listing. The city fleet has been using Pure Power! oil filters for the last year. According to Paul Condran, equipment maintenance manager, the filters used in the city’s fleet of vehicles never have to be replaced and can be retained and reused as fleet vehicles are replaced. “They are providing us with an excellent way to clean the oil, especially in our expensive heavy- and medium-duty natural gas engines,” he said. Condran stated the City will eventually have the entire fleet converted.

Safer FMCSA Trucker Regulations Reduce Deaths by 20%

vehicle accidentThis month the National Highway Traffic Safety Administration announced that the number of truck driver traffic fatalities had declined 20 percent in 2009, dropping from 4,245 in 2008 to 3,380 in 2009. The reduction in large truck-related deaths is the lowest level in recorded Department of Transportation history. The results also show a 33 percent decrease in fatalities since the stricter Federal Motor Carrier Safety Administration (FMCSA) hours-of-service regulations became effective in January 2004.

In addition to the 20 percent reduction in crash fatalities involving large trucks, the number of truck occupant deaths decreased 26 percent in 2009, from 682 in 2008 to 503 in 2009. The number of truck occupants injured in truck-related crashes also declined 26 percent. Those are the largest declines among all vehicle categories.

Travelers Insurance is one of the world’s largest insurance companies. Traveller’s Insurance announced this week that it is now paying fleets in the form of insurance discounts if the fleet installs fleet telematics systems. According the a TRV press release, the fleet must install vehicle telematics technology “in a sufficient number of their fleet vehicles and that they are actively incorporating safety information from the devices into their ongoing safety feedback to drivers, at least on a quarterly basis.”

Carrier Corp Uses GPS Fleet Data to Save $1 Million

With over 3,000 fleet trucks and cars in North America, Carrier reduced emissions by more than 30 percent since 2006 by deploying a diverse set of strategies, including right-sizing fleet vehicles and monitoring driving patterns using global positioning system (GPS) data to removing unnecessary weight from fleet vehicles.

Carrier Corporation is reducing its fuel use and green house gas emissions following an analysis of the company’s entire fleet of vehicles. Carrier changed its sales fleet by removing gas guzzling trucks in favor of hybrids and smaller engine vehicles. Carrier’s GPS system generates data that has provided visibility to other savings opportunities, for instance, carrying unnecessary equipment in trucks increased both weight and gasoline usage. Fleet vehicles now carry only the tools and parts that are required. The GPS technology provides data for fuel economy performance across the country and has led to an average mile per gallon increase of nearly 7 percent, according to the Carrier Corp.
